We operate a mobile-based as well as a web-based application called Portal Horse. This privacy notice concerns this app.
What features does the app have?
You can use the app to mainly do the following:
Send and receive messages to and from other users
Make posts and edit them, react to posts made by other users
Create events for other users
Write articles
Stream races and follow race results
Communicate with stables, purchase their services, check overview of purchased services and pay for them
Place ads on the marketplace and respond to ads of other users
Watch and read academia content
Sell or buy horses in the auction
Portal Horse may revise this Privacy Notice from time-to-time. You are welcomed to check this Privacy Notice regularly to ensure you are familiar with the current version.

What data do we use and where do we get your data from?
All information which allows us to identify you directly or indirectly or which is related to you is considered personal data. We only use personal data which is necessary for the purposes listed in this Privacy Notice.
Data about persons who subscribed to receive our marketing communications
If you subscribe to receive our marketing communications, we collect and use your e-mail address which you fill in the subscription form when subscribing to receive our newsletters.
If you do not give us this data, we will not send you our marketing communications.
Data about all our registered users
If you register in our app, we collect and use data which you fill in the registration form when creating your user profile. These data include identification data, contact data, and voluntarily your interests and your photo.
If you choose to register via your Facebook account, Google account, or Apple ID, we obtain the above listed data from providers of these services.
If you do not give us your identification and contact data, you will not be able to register your profile in the app and use it.
If you do not give us your interests and other voluntary data and your photo, we will not be able to show it to other users which may affect your experience when interacting with other users.
We also collect your feedback received from you via our customer support or other feedback forms. Giving feedback is voluntary.
Data about horse riding instructors and riders
If you are a horse riding instructor or a rider, we also collect your licence number and the name of the federation which you are a registered member of, when you fill such information in the registration form while creating your profile. We may check this data with publicly available sources.
If you do not give us such data, they will not be listed in the app.
Data about our customers
If you communicate via our app with stables and purchase any of their services, we use your registration data from creation of your user profile, and collect and use, if applicable, also the data you fill in the order form when purchasing the services in our app. These data include identification data, contact data, and transaction data.
If you do not give us this data, you will not be able to use the features of the app related to the communication with stables and purchasing their services.
Data about our business partners and their representatives
If you are our current or potential business partner, we use data which you give us, or which is publicly available. These data include identification data, contact data, information about your position in your organization and information about and from our mutual communication. Such data is necessary so that we can fulfill obligations from our mutual agreements.
Data about all our website users gathered by cookies
Except for the above-explained instances of processing your personal data, if you use our website, we use cookies to collect your personal data with the help of your internet browser. We collect and use data about your device (such as device type, operating system, browser used, connection provider) and website usage data (such as the date, time, and duration of your visit, presumed country from which you visit our website, website browsing history).

Your registration enables you to use our app. Our use of your personal data is a contractual requirement, and therefore, if you do not give us your personal data by creating your user profile, you cannot proceed to use the app – only registered users can use the app.

Also, upon request, we may disclose your data to public authorities (such as tax or customs officers, governmental authorities, law enforcement agencies, courts, or the police). Feedback on the app. Our legitimate interest is to evaluate your satisfaction with our app so we could tailor it for your utmost benefit. If you use it, we use your personal data to improve the app’s current features and develop new ones which would be in line with your interests expressed by your usage of the app.

Data about horse riding instructors and riders
If you are a horse riding instructor or a rider and give us your licence number and the name of the federation which you are a registered member of, we may show it to other users. We also collect this data for the app’s future features. Such use of your personal data is based on our legitimate interest of enabling our users to find horse riding instructors and riders and use their services.
Data about our business partners and their representatives
Communication. If you are our current or potential business partner, we use your data to communicate with you about our business matters. Our use of your personal data is a contractual requirement, and therefore, without your data, we will not be able to communicate with you and fulfil our contractual obligations.

We highly respect your personal protection. Therefore, in general, we disclose your data to other parties only when we have your consent.
Without your consent, we disclose your data to third parties only if it is necessary for the following reasons:
To use the app’s features
To providers of the purchased services. If you purchase any services in the app, we will share your data with our business partners who provide you with the services which you purchased. Our business partners are mainly stables and payment gates administrators. The transfer of your data is necessary to process your orders of services so that they can be provided to you.
To other users. If you are an active user, actions that you do in the app while using its features may be visible to other users. This means that, for example, if you make a post, other users can see it, react to it, and write comments. The post will be made under your registered name and other users will be able to see your profile.
If you are our business partner, we will share your data with the users so that they can purchase and use your services.
To ensure functioning of our app and our internal processes
We may disclose your data to reliable third parties that provide us with administrative, technical, or legal support.
To comply with legal requirements
Upon the request, we may disclose your data to public authorities (such as customs officers, governmental authorities, law enforcement agencies, courts, or the police). We disclose your data only to the necessary extent and within the boundaries of law.
Transfer to third countries
Currently, we do not disclose your personal data to recipients in countries outside the European Union and the European Economic Area or to any international organization.

With your consent
Where we use your personal data based on your consent, such personal data will only be used for the duration which you consented to. Giving your consent is voluntary. Regardless of the consent duration, you may withdraw your consent anytime. If you do so, we will stop using your personal data for the purpose for which we collected your consent.
Currently, we ask for your consents for the following:
To send you marketing communications – we collect your consent for the period of 3 years after you subscribe
To use cookies and other forms of user tracking – we collect your consent for the period of 12 months

Our contractual obligations
Where we use your personal data to fulfill our contractual obligations or where it is necessary for our exercise of rights and obligations in connection with the contract, such personal data is used for the duration of the given contract and usually for 3 years since the termination or expiry of the last contract. The duration may be exceptionally extended to 10 years.
Our legal obligations
Where we use your personal data to fulfil our legal obligations, we use such personal data for the period set out by the relevant legal regulations (primarily in accordance with tax regulations for a period of 10 years from the issuance of the relevant invoices and documents for your order).
Our legitimate interests
Where we use your personal data, in particular your feedback, to improve the app and develop new features which would be in line with your interests expressed by your usage of the app, we use your data for the period for which you are our registered user.
Where we use your interests and voluntary data and your photo that you voluntarily gave to us, we use it for the period for which you are our registered user or until you delete it from your account. Deleting this data is fully under your control and can be done any time in the profile settings.
Where we use your licence number and the name of the federation which you are a registered member which you voluntarily gave to us if you are a horse riding instructor, we use it for the period for which you are our registered user or until you delete it from your account. Deleting this data is fully under your control and can be done any time in the profile settings.
Where we use your data for sending you marketing communications without your given consent, your personal data is used for a maximum of 3 years after the termination of your registration or until you raise an objection or unsubscribe from the marketing communications.
Where our use of your data is necessary for our other legitimate legal or business purposes (such as for financial record- keeping or to finish open business transactions), we may use your data for longer period of time, until the relevant purpose will have been accomplished. Such situation may occur when we actively exercise our rights, then we keep the data until our rights were defended.
We use your personal data in a secured database in a safe environment. In order to ensure protection against unauthorized access or unauthorized alteration, disclosure or destruction of your data, we have adopted organizational and technical measures to secure them, which we strictly adhere to.
Your messages are encrypted and stored on our servers.

What are your rights?
When you exercise your rights, we will provide you with response to your requests within 30 days. In case of more demanding request, we are allowed to extend the period, but in any case, we will let you know.

Access to your personal data
You have the right to know if we use your data. If you ask us, we will tell you whether we use your data or not. If yes, you can also ask us to get information how we use your data and obtain a copy of the data we use.
Withdraw your consent at any time
You have the right to withdraw consent where you have previously given your consent to the use of your data. The withdrawal of consent does not mean that the prior use of your data before the withdrawal was unlawful, but we will not use your data for the reasons for which you withdrew the consent anymore.
Verify and seek rectification
You have the right to verify the accuracy of your data and ask us to update or correct the data we currently use.
Have your personal data deleted
You have the right, in certain situations, to ask for the erasure of your data which we retain. This right applies for example, when you withdraw your consent or when the data is no longer necessary for the reason, for which we used them. We strive to erase your data always when it is no longer needed. However, please bear in mind that there are situations, in which we are not able or allowed to delete your personal data.
Restrict our use of your personal data
You have the right, in certain situations, to restrict our use of your data. This right applies for example, when you contest the accuracy of the data or when you deem our use of your data unlawful.
Receive your personal data and have it transferred to another controller
Under some circumstances, you have the right to receive your data in a structured, commonly used, and machine-readable format and, if technically feasible, to have it transmitted to another controller without any hindrance.
Object to our use of your personal data
You have the right to object, for reasons relating to your particular situation, to our use of your data which is based on our legitimate interests, including direct marketing communications. If you object to our use of your data, we will not use your data until we decide on the rightfulness of your objection.

The Office for Personal Data Protection is the applicable supervisory authority of Portal Horse. You can also lodge a complaint with a different supervisory authority in the European Union applicable in your case. Lodging a complaint does not prevent you from making any claims regulated under national law.
Archiving in the public interest
We may archive your data in the public interest and use them for scientific, historical, or statistical research purposes. In well- founded cases, your data can also be used for the reason of legal matters resolution, including the performance of our obligations towards public administration bodies, and monitoring and ongoing evaluation of legal risks.
Age limit
You must be at least 15 old to be able to use our app. Only by determining the minimum age we may become assured that our services are only used by persons for whom they are intended.
No fully automated decision-making
We do not make any decisions based solely on automated processing, including profiling. On the contrary, we always involve human review when we make our decisions.
